PUSH Terms of Use

These Terms are an agreement between you and Crenshaw & Holmes Group LLC about your use of the PUSH app, Push Nation and joinpushnow.com (together, "PUSH"). By creating an account or using PUSH, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use PUSH.

1. What PUSH is, and what it isn't

PUSH is a peer support and accountability tool for people who want to stop gambling, and for the people who support them.

PUSH is not medical care, therapy, counseling or a crisis service. It doesn't diagnose or treat any condition and isn't a replacement for professional help. Nothing in PUSH, including content from the founder, moderators or other members, is medical or financial advice.

If you are in crisis, don't rely on PUSH. Call or text 988 (Suicide & Crisis Lifeline), call 1-800-GAMBLER for gambling help, or call 911 if you or someone else is in danger.

2. Who can use PUSH

You must be at least 18 years old to use PUSH. You agree to give accurate information when you sign up and to keep your password private. You're responsible for activity on your account.

3. Your Push and invitations

Only add someone as Your Push if they're comfortable being your support contact.
Only send a PUSH invitation to someone you know, and respect their choice if they're not interested. Don't use invitations to pressure, harass or spam anyone.
Calls and texts you make from PUSH go through your phone's own apps and are between you and the other person.

4. Push Nation community rules

Push Nation works because people feel safe there. When you post, reply or interact, you agree to these rules:

Be real. Share your own story.
No betting talk that pulls people back. No picks, odds, lines, parlays, promo codes or "one last bet."
No selling or promoting. No ads, links to gambling sites, or anything for sale.
Respect everyone. No judging, shaming, hate, threats or harassment.
Keep it anonymous. Don't share anyone's real name, phone number, address or photos, including your own.
Slips happen. Meet them with support, not judgment.
This is peer support, not professional help.

Also don't post anything illegal or sexually explicit, impersonate anyone (including PUSH staff), or try to break or misuse PUSH.

Moderation. The founder and moderators may remove any content and may suspend or ban accounts that break these rules, at our discretion. You can report posts and block other members at any time. We don't promise to review every post, and members' posts reflect their own views, not ours.

5. Your content

You own what you post. By posting in Push Nation, you give us a non-exclusive, royalty-free, worldwide license to host, store, display and share it within PUSH so the community can work. We will not use your posts outside PUSH (for example, in marketing) without asking you first. If you delete a post, or your account, we remove it from PUSH.

6. PUSH Premium subscriptions

Some features (Push Nation, Progress, badges and celebrations, Push Count and money protected) require a PUSH Premium subscription. The PUSH button, Your Push, crisis resources and the supporter experience stay free.
Plans: monthly or yearly, at the prices shown in the app before you buy.
Free trial: eligible new subscribers get a 7-day free trial. Unless you cancel before it ends, your subscription starts and you're charged at the end of the trial.
Auto-renewal: subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged within 24 hours before renewal.
Cancel anytime in your iPhone's Settings › [your name] › Subscriptions. Canceling stops future charges. You keep access until the end of the period you paid for.
Payments and refunds are handled by Apple under Apple's terms. To ask for a refund, contact Apple.
Deleting your PUSH account does not cancel your subscription. Cancel it with Apple.
We may change prices with advance notice as required by Apple and the law.

7. Sponsor rewards

From time to time, PUSH may offer rewards from sponsors when you reach milestones. Rewards are earned, not won: there are no drawings, chances or games of luck. Rewards are limited, can change or end at any time, and may require an active subscription or other eligibility. Sponsor rewards are provided by the sponsor under its own terms.

8. Things you agree not to do

Don't copy, resell or reverse-engineer PUSH; access other people's accounts or data; use bots or scrapers; interfere with PUSH's security; or use PUSH for anything illegal.

9. Our content

PUSH, its name, logos, design, text and software belong to Crenshaw & Holmes Group LLC and are protected by law. We give you a personal, limited, non-transferable license to use the app for its intended purpose under these Terms.

10. Ending your account

You can delete your account anytime in Account Settings. We may suspend or end your access if you break these Terms or if we need to protect PUSH or its members. Sections that by their nature should continue (like disclaimers and limits of liability) survive.

11. Disclaimers

PUSH is provided "as is" and "as available." To the fullest extent allowed by law, we make no warranties of any kind, express or implied, including that PUSH will be uninterrupted, error-free or will achieve any particular result. Recovery is personal, and results vary.

12. Limitation of liability

To the fullest extent allowed by law, Crenshaw & Holmes Group LLC and its owners, moderators and partners won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of money, data or profits, arising from your use of PUSH. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or $50. Some places don't allow these limits, so they may not fully apply to you.

13. Indemnity

If you break these Terms or the law, or post something that leads to a claim against us, you agree to cover our reasonable costs from that claim, to the extent allowed by law.

14. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Morris County, New Jersey, unless the law requires otherwise.

15. Changes to these Terms

We may update these Terms. If the changes are important, we'll tell you in the app or by email before they take effect. Continuing to use PUSH after that means you accept the updated Terms.

16. Apple App Store terms

If you downloaded PUSH from Apple's App Store:

These Terms are between you and Crenshaw & Holmes Group LLC, not Apple. Apple is not responsible for PUSH or its content.
Your license to use PUSH is limited to Apple-branded devices you own or control, as allowed by Apple's Usage Rules.
Apple has no obligation to provide maintenance or support for PUSH. For support, contact hello@joinpushnow.com.
If PUSH fails to meet an applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app (if any). To the extent allowed by law, Apple has no other warranty obligation for PUSH.
Apple is not responsible for handling any claims about PUSH, including product liability claims, claims that PUSH fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
If anyone claims PUSH infringes their intellectual property, Apple is not responsible for investigating, defending or settling that claim.
You confirm you are not located in a country subject to a U.S. government embargo or designated as "terrorist supporting," and you are not on any U.S. government list of prohibited or restricted parties.
You must follow any third-party terms that apply when using PUSH (for example, your wireless carrier's terms).
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
